1. Who we are and what these Terms cover

Sought Creative is a local creative directory and discovery platform operated by Alabaster Photos, LLC, a Wisconsin limited liability company (“Sought Creative,” “we,” “us,” or “our”). These Terms govern your access to and use of the Sought Creative website, creator dashboard, directory, listing tools, memberships, comparison features, request forms, and related services (collectively, the “Platform”).

By accessing the Platform, creating an account, submitting a listing, or purchasing a membership, you agree to these Terms. If you do not agree, do not use the Platform.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter into a binding agreement. You are responsible for providing accurate account information, maintaining access to the email address connected to your account, and all activity conducted through your account.

You may not impersonate another person or business, create an account using information you do not have permission to use, or transfer your account without our written approval.

3. Sought Creative’s role

Sought Creative currently provides directory, advertising, comparison, and discovery tools. Unless a future feature expressly states otherwise, we are not a party to agreements between customers and providers. Providers independently set their prices, availability, policies, qualifications, service areas, and fulfillment terms.

We do not employ providers, guarantee their work, verify every statement they make, or guarantee that a customer or provider will complete a transaction. Users are responsible for evaluating whether another user, listing, service, product, space, or rental is appropriate for their needs.

4. Provider listings and responsibilities

Providers must submit truthful, current, and complete information. You must have all licenses, permissions, insurance, releases, rights, and qualifications required for what you offer. You are solely responsible for your services, products, rentals, spaces, communications, contracts, taxes, refunds, safety practices, and customer obligations.

Listing approval means only that we allowed the listing to appear on the Platform. It is not a certification, endorsement, guarantee, background check, or warranty. We may approve, decline, pause, edit for formatting, request changes to, or remove a listing when reasonably necessary to protect users, comply with law, or enforce these Terms.

5. Memberships, renewals, and cancellation

Community listings are free unless otherwise stated. Paid Pro, Business, and Founding Pro memberships renew automatically at the billing interval shown at checkout until canceled. The price, billing interval, and material membership terms are displayed before purchase.

You may cancel at any time by contacting mandie@alabasterphotos.com. Cancellation stops future renewals and takes effect at the end of the current paid billing period. You retain paid access until then unless access is suspended for a violation of these Terms.

Founding pricing remains available only while the qualifying membership remains continuously active. If it is canceled or payment fails and the membership ends, the founding rate may no longer be available.

6. Fees, taxes, failed payments, and refunds

Membership fees are charged through Stripe and are generally nonrefundable once a billing period begins, except where required by law. We may issue a full or partial refund at our discretion. Canceling does not create a right to a prorated refund for the unused portion of a billing period.

You authorize us and our payment processor to charge the payment method provided at checkout for recurring fees and applicable taxes. If payment fails, we may retry the charge, limit paid features, pause listings, or end the membership. You remain responsible for legally applicable taxes associated with your own business and offerings.

7. Your content and intellectual property

You retain ownership of photographs, artwork, text, logos, product images, and other materials you submit (“User Content”). You represent that you own the User Content or have permission to use and license it.

You grant Sought Creative a nonexclusive, worldwide, royalty-free license to host, store, reproduce, resize, display, and distribute your User Content only as reasonably necessary to operate, promote, and improve the Platform and your listings. This license ends when the content is removed, except for reasonable backup, archival, legal, and previously published promotional uses.

Do not upload content that infringes copyrights, trademarks, privacy rights, publicity rights, contractual rights, or other rights. We may remove allegedly infringing content and restrict repeat infringers.

8. Acceptable use

You may not use the Platform to engage in fraud, harassment, discrimination, illegal activity, unsafe conduct, deceptive advertising, spam, unauthorized data collection, security testing, malware distribution, or interference with the Platform. You may not list stolen, counterfeit, prohibited, or unlawfully obtained items.

You may not manipulate search placement, create fake accounts, submit false reviews, purchase or sell deceptive endorsements, or misrepresent an affiliation with Sought Creative. Honest opinions and lawful reviews may not be restricted merely because they are unfavorable.

9. Customer requests and communications

Information submitted through Sought & Found or other request forms must be accurate and lawful. We may share a request with potentially relevant providers as described at submission. A match or introduction does not guarantee suitability, availability, price, response, or completion.

Users are responsible for their communications and any agreement reached outside the Platform. Do not send sensitive financial, medical, identity, or security information through public listings or ordinary inquiry messages.

10. Third-party services and links

The Platform may link to provider websites, social accounts, Stripe checkout, maps, or other third-party services. Their own terms and privacy practices apply. We do not control and are not responsible for third-party content, availability, security, products, services, or conduct.

11. Suspension and termination

You may stop using the Platform at any time. We may suspend or terminate access, pause or remove listings, or preserve relevant information when we reasonably believe it is necessary to enforce these Terms, protect users, investigate misconduct, respond to legal process, prevent harm, or maintain Platform security.

Sections that by their nature should survive termination—including ownership, disclaimers, liability limits, indemnification, dispute provisions, and accrued payment obligations—will survive.

12. Disclaimers

To the fullest extent permitted by law, the Platform is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or that listings, matches, providers, customers, services, spaces, rentals, products, or results will meet your expectations.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

13. Limitation of liability

To the fullest extent permitted by law, Sought Creative and Alabaster Photos, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, goodwill, or opportunities; or disputes, injuries, losses, or damages arising from another user, provider, customer, listing, transaction, service, product, rental, or space.

Our total liability for claims relating to the Platform will not exceed the greater of $100 or the membership fees you paid to us during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot legally be limited.

14. Indemnification

To the extent permitted by law, providers and other business users agree to defend, indemnify, and hold harmless Sought Creative, Alabaster Photos, LLC, and their owners, personnel, and contractors from third-party claims and reasonable costs arising from their listings, User Content, offerings, fulfillment, taxes, contracts, violations of law, or breach of these Terms.

15. Governing law and disputes

These Terms are governed by Wisconsin law, without regard to conflict-of-law principles. Before filing a claim, you agree to contact us and make a good-faith effort to resolve the issue informally. Unless applicable law requires otherwise, disputes must be brought in the state courts serving St. Croix County, Wisconsin, or the federal courts for the Western District of Wisconsin.

Nothing in this section prevents either party from seeking appropriate relief for intellectual-property misuse, security threats, fraud, or other urgent harm.

16. Changes to the Platform or these Terms

We may change the Platform and update these Terms as the business evolves. If a change materially affects paid memberships, we will provide reasonable notice through the Platform or the email associated with your account. Continued use after the effective date of revised Terms constitutes acceptance where permitted by law.

Marketplace booking, provider payouts, shipping, transaction fees, reviews, and other future features may require additional terms or policies before launch.

17. General terms

If part of these Terms is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization, sale, merger, or transfer of the Platform. These Terms and any incorporated policies form the entire agreement about the current Platform.
